Mental Health Act 1983

The 1983 Mental Health Act (MHA), amended in 2007, impacts on the lives of a wide range of people who use mental health services – in England and Wales. The MHA is supported by additional legislation, guidance, regulations – and case law.

Approved Mental Health Professionals (AMHPs) make independent decisions regarding the making of applications under the MHA.

A nearest relative can request for a Mental Health Act assessment to be carried out by an Approved Mental Health Professional (AMHP) for a family member if they have concerns for their mental illness.  In an area where we provide mental health services, a nearest relative can contact EPUT on 0300 123 0808 to be directed to a community mental health team. A duty worker form the community mental health team will then discuss the referral with the nearest relative.
